ACCESSING OUR WEBSITE, MAKING A PURCHASE, OR USING OUR SERVICES, YOU AGREE TO BE BOUND BY
THESE TERMS. IF YOU DO NOT AGREE, DO NOT USE OUR SERVICES.
This document
constitutes a legally binding agreement (“Terms”) between you (“you,” “your,” or “user”)
and HYPESTUDIOS, LLC (“HYPESTUDIOS,” “we,” “us,” or “our”). These Terms, along with our
Privacy Policy and Server Rules, govern your access to and use of the HYPEMC.NET website,
its associated web store, and all related services (collectively, the “Services”). By
accessing or using any of our Services, you agree to be bound by all of these documents.
ACCEPTANCE OF TERMS AND ELIGIBILITY
By using our Services, you confirm that you have read,
understood, and agree to be bound by these Terms. If you are under the age of 18 or the
age of legal majority in your jurisdiction, you represent that your parent or legal
guardian has reviewed and agreed to these Terms on your behalf. Our Services are intended
for users who are at least 13 years of age.
These Terms work in conjunction with
our in-game Server Rules, which are available at https://www.hypemc.net/rules and are
incorporated herein by reference. A violation of the Server Rules constitutes a violation
of these Terms.
YOUR ACCOUNT AND SECURITY
You are responsible for all activities that occur under
your Minecraft account and for maintaining the security of your account credentials.
HYPESTUDIOS is not liable for any loss or damage arising from your failure to protect your
account, including any loss of virtual goods.
RELATIONSHIP WITH MOJANG AB
HYPESTUDIOS, LLC is an independent entity and is in no
way affiliated with Mojang AB or Microsoft™. HYPEMC.NET is not an official Minecraft
service and is not endorsed or approved by Mojang AB.
WEB STORE, VIRTUAL CURRENCY, AND PAYMENTS
Our web store allows you to purchase a limited license
for virtual goods, including our virtual currency known as “Crystals.”
- Limited License, Not Ownership: When you purchase “Crystals” or other virtual items, you obtain a limited, personal, non-transferable, revocable license to use those virtual goods exclusively within our Services. You acknowledge that you do not acquire any ownership rights. “Crystals” have no cash value and cannot be redeemed for real money, goods, or services.
- Payment Processing: All transactions are processed through secure, third-party payment providers. By initiating a purchase, you are agreeing to the terms and conditions of the payment provider you select for the transaction.
- No Refund Policy: All purchases are final. You expressly consent to the immediate delivery of digital content upon purchase and acknowledge that you thereby lose your right of withdrawal. We are not obligated to provide a refund or credit for any reason, including if you are banned for violating these Terms or our Server Rules. Notwithstanding the foregoing, we reserve the right, in our sole discretion, to issue refunds or credits in exceptional circumstances (e.g., as a result of a verified technical fault in our payment system).
- Transaction Inquiries and Disputes: For any questions or issues regarding a transaction, such as a failure to receive purchased goods, you must contact us first at support@hypestudios.net. We will investigate your claim and assist you. Initiating a fraudulent chargeback or payment dispute through your bank or card issuer for a valid transaction will be considered a breach of these Terms and may result in the permanent termination of your account and a ban from all our Services.
RULES OF CONDUCT AND ENFORCEMENT
Your use of the Services is conditioned on your
compliance with our Server Rules. Violation of these rules may result in a temporary or
permanent suspension (“ban”) of your account. If your account is banned, your access to
the Services, including any purchased virtual goods, will be suspended. A ban, regardless
of its duration, does not entitle you to a refund. In the event your ban is confirmed as
permanent, your license to use any purchased virtual goods is considered terminated and
forfeited. While we may offer an appeals process for account suspensions through our
official Discord server, the final decision rests solely with HYPESTUDIOS.
INTELLECTUAL PROPERTY
All content and materials included in the Services
(excluding User-Generated Content) are the exclusive property of HYPESTUDIOS, LLC and are
protected by international intellectual property laws. We grant you a limited,
non-exclusive license to use the Services for your personal, non-commercial entertainment.
USER-GENERATED CONTENT
Any content you create, build, upload, or make available
within our Services, including but not limited to in-game structures, is considered
“User-Generated Content” (UGC). You retain any intellectual property rights you have in
your UGC. However, by creating UGC, you grant HYPESTUDIOS a worldwide, royalty-free,
perpetual, irrevocable, and sublicensable license to use, host, store, reproduce, modify,
create derivative works from, display, and distribute your UGC in connection with
operating and promoting the Services.
DISCLAIMERS AND LIMITATIONS
THE SERVICES ARE PROVIDED ON AN “AS IS” AND “AS
AVAILABLE” BASIS. HYPESTUDIOS DOES NOT GUARANTEE THAT THE SERVICES WILL BE UNINTERRUPTED,
SECURE, OR ERROR-FREE. WE ARE NOT RESPONSIBLE FOR ANY LOSS OF VIRTUAL GOODS. TO THE
FULLEST EXTENT PERMITTED BY LAW, HYPESTUDIOS SHALL NOT BE LIABLE FOR ANY INDIRECT,
INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES.
GOVERNING LAW
These Terms and any dispute arising from them shall be
governed by and construed in accordance with the laws of the State of Wyoming, USA,
without regard to its conflict of law principles.
DISPUTE RESOLUTION BY BINDING ARBITRATION
PLEASE READ THIS SECTION CAREFULLY AS IT AFFECTS
YOUR RIGHTS.
You and HYPESTUDIOS agree that any dispute, claim, or
controversy arising out of or relating to these Terms or the Services shall be resolved by
binding arbitration, rather than in court. The arbitration will be administered by the
American Arbitration Association (AAA) under its Consumer Arbitration Rules.
You
and HYPESTUDIOS agree that each may bring claims against the other only in your or its
individual capacity, and not as a plaintiff or class member in any purported class or
representative proceeding. By agreeing to these Terms, you are waiving your right to a
trial by jury and to participate in a class-action lawsuit.
INDEMNIFICATION
You agree to indemnify, defend, and hold harmless
HYPESTUDIOS, LLC and its affiliates, officers, and employees from and against any claim,
liability, damage, loss, or expense, including reasonable attorneys' fees, arising
out of or in any way connected with your access to or use of the Services, your violation
of these Terms, or your infringement of any intellectual property or other right of any
third party.
SERVICE TERMINATION OR DISCONTINUATION
We reserve the right to modify, suspend, or terminate the
Services, or your access to them, at any time for any reason. In the event of a permanent
discontinuation of the Services, you will not be entitled to any refund or compensation
for any virtual goods.
UPDATES TO THESE TERMS
We may update these Terms from time to time. The updated
version will be indicated by the revised “Last Modified” date. Your continued use of the
Services after any changes are posted constitutes your acceptance of the new Terms.
